You agree to indemnify, defend, and hold harmless Stratosync, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

Your use or misuse of our services
Your violation of these Terms and Conditions
Your violation of any rights of another party
Your breach of any representations or warranties provided

No Warranty of Results

WE MAKE NO GUARANTEES OR WARRANTIES REGARDING EMPLOYMENT OUTCOMES, SALARY INCREASES, CAREER ADVANCEMENT, CERTIFICATION SUCCESS, OR ANY OTHER SPECIFIC RESULTS FROM COMPLETING OUR COURSES.

Individual results depend on numerous factors including but not limited to prior experience, dedication to learning, market conditions, economic factors, and personal circumstances beyond our control.

Service "As Is"

Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Content Accuracy

While we strive to provide accurate and up-to-date course materials, we make no warranties regarding the completeness, accuracy, reliability, or currency of any content. Cloud technology evolves rapidly, and some information may become outdated.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STRATOSYNC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

This limitation applies regardless of the legal theory upon which the claim is based, including breach of contract, breach of warranty, tort (including negligence), strict liability, or any other theory, even if we have been advised of the possibility of such damages.

Our total liability for any claims arising from or related to our services shall not exceed the amount you paid for the specific course or service giving rise to the claim, or one hundred Indian Rupees (₹100), whichever is greater.

Excluded Damages Include:

Lost employment opportunities or salary
Failed certification attempts
Time invested in courses
Business losses or interruptions
Damaged professional reputation
Lost data or information

Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of India, without giving effect to any principles of conflicts of law. Any legal action or proceeding arising under these terms shall be brought exclusively in the courts located in Hyderabad, Telangana, India, and you consent to personal jurisdiction in such courts.

Dispute Resolution

In the event of any dispute, controversy, or claim arising from these Terms and Conditions, the parties agree to first attempt to resolve the matter through good-faith negotiations. If negotiations fail to resolve the dispute within thirty days, either party may pursue legal remedies as provided herein.

Waiver of Class Actions

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Force Majeure

Stratosync shall not be liable for any failure or delay in performance of its obligations under these Terms and Conditions due to causes beyond its reasonable control, including but not limited to:

Acts of God, natural disasters, epidemics

War, terrorism, civil unrest

Government actions or regulations

Internet or telecommunications failures

Power outages or equipment failures

Labor disputes or strikes

Severability

If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable while preserving its intent, or if such modification is not possible, the provision shall be severed from these Terms and Conditions. The remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms and Conditions, together with our Privacy Policy, Cookie Policy, and any other legal notices published on our website, constitute the entire agreement between you and Stratosync concerning your use of our services.
